In a recent decision, the Ninth Circuit held that "the ECPA unambiguously applies to foreign citizens." In Suzlon Energy Ltd. v. Microsoft, Suzlon Energy demanded Microsoft to produce emails from the Hotmail email account of an Indian citizen imprisoned abroad.
